Can my boss fire me for this reason?

illinois motel
__A_YAHOO_USER__ asked:

My boss said he would fire me if I didn’t sign a warning. It’s my 1st warning and I thought it was suposed to be verbal? He said we have 15 minutes to clean a full double bed motel room. I went over my time by 2.4 minutes. I refused to sign the warning. I spoke to a customer who seen me get fired in public *and yelled at* She sent me an email from him saying he gives us 40 minutes a room. What should I do? I looked on Illinois Dept. of Labor. I reside and work in Centralia, IL. I don’t know what I should look for. Thanks for any help offered.
You misunderstood the question moron. I was NOT late. We used to get 30 minutes to clean a motel room. which requires, stripping beds, making them, sterilizing bathrooms *which we have to leave the disinfectant on for 10 min for it to sterilize* We have Fridges, Microwaves, coffee pots to clean. Dust, check drawers, clean air conditioner filters, clean mirrors, windows etc. NOT including the messes some people leave. (The new owner spent the rest of his money on plane trips to visit his family in Arkansas and to Disneyland, plus his girlfriend lives upstairs as well).
I didn’t sign any papers with him. He bought the place Nov. 22nd. I have an email he sent out saying we have 40 minutes per room, Which he is short on cash and forcing us to NOT change sheets or clean showers He wants me to take a dirty towel *to save laundry fees* to dry the tub and toilet and bathroom floor to make it *look clean*. I did as he said but I couldn’t let the beds go unchanged. It’s America’s Best Value Bell Tower Inn. I am looking for anyone with a legal website to help me. It’s disgusting. I plan on contacting the Health Dept. I did talk to my other co-worker’s. They plan on filing complaints.
I filed for unemployment today and I get $115.00 bi-weekly. This guy is a joke. He is doing this because he spent his money and is close to bankruptcy. So he is forcing us to cut corner’s and chance someone’s health and he won’t even pay for an exterminator for the bed bugs, which I never knew existed…

I would fire you. If you can’t meet the 15 minute standard, you should go.

  2. You can be fired for any reason. It’s the American way :)

  3. Kenya C says:

Yes, he can fire you for that, as telling you that he will fire you for not signing it constitutes as a warning.

  4. Brandon L says:

seems kinda harsh, but he legally can, sorry

  5. Talk to coworkers. If he gave you a different set of standards than ther others got then he was just looking for an excuse to fire you and would be open to being sued by you.

  6. r.chuck65 says:

he can’t fire you for not signing a warning notice. If he fires you, you have a case against him and the company.

  7. Makeshift says:

Do yourself a favor- let it go! He sounds like a jerk anyway-be thankful you don’t have to deal with that creature anymore. There are lots of jobs out there right now!

  8. Blackstone says:

when you were hired, you signed a paper that said that your boss(es) can fire you for any reason with or without proof. you could contest the termination in court if you really feel that you were terminated wrongly. the jury would probably fall on your side because 2.4 minutes is not bad. in short, you would probably win wrongful termination case in court.

  9. Joshlyn says:

Most employment is considered at will which means either you or your employer can terminate the employment agreement with no questions asked. If there’s discrimination or some sort of abuse then it’s different story and requires further research.

I would just sign it to shut the a** up and try to shave a few minutes off your time. Try getting in touch with higher ups (a corporate office if it is a chain hotel) and find out exactly what the standards are and what the warning process should be.

  11. Erica R says:

Sorry, he can fire you. Bosses can fire you for anything…even if you style your hair a certain way. However, if you had a policy during orientation and stated that you must receive a verbal 1st…then you might be able to get somewhere…I would collect unemployment.

I’d consult the handbook you were inevitably given when you started working at this m/hotel. If it says clearly that your first warning shall be verbal, then ask him why he’s diviating from the rules. If he lies and says you’ve had a verbal warning before, ask to see your personnel file and where he recorded this verbal warning. It’s his responsibility, or the housekeeping manager’s responsibility, to track stuff like that and if they didn’t, it’s their loss.
You should also show him a COPY OF that email – ask him why he’s lying to customers. That oughtta get him to back up off you for awhile anyways.
Unfortunately, if somebody really wants you out, they’re gunna get you out. Sorry girl.

Illinois is a ‘right to work’ state. Meaning you can be fired for any reason the employer chooses to give. Go to the unemployment office and file a claim.

If it is a motel chain go to corporate office. To raise a protest.

If it is a private owner well I’d get out my don’t like list and put this one on the list to tell all my –

friends in public to be heard out loud of how big of a creep this jerk was and the reason..

Why because if one person hears you in public talking of this case .. word eventually gets around and you know what that will mean

    For Sale make offer

You are considered at at will employee. He can fire you for any reason unless you are bound by some kind of collective bargaining agreement. Sorry.

  16. lizards says:

You are to sign the warning notice to acknowledge that you have been told and are aware of the situation. These often need to be signed whether they are written or verbal to be legally binding. Not signing shows that you do not agree you have done anything wrong. He may fire you as he wishes, however you can take it to the unemployement office and file complaint. They will investigate and if they see in your favor, the company will have to pay you a small percentage of what you were being payed for a temporary length of time. This is a great holdover until you find other employment

  17. AMC says:

    Wrong full termination.
You never sign something that you don’t agree with you have every right to do so.I allways thought that 30 mins is the normal time for cleaning a room. There is no way you can clean a room in 15min. It sounds like he is trying to cut his emplyee expenses. Maybe you can get him on that.

  18. Barry C says:

Maybe because you come here asking for advice, and when you don’t like what you get, you lash out and call people morons, that your boss discerns an attitude issue.

If you think they are not following health codes, then by all means report it, but that is independent of whether of not you can be fired. You can be 100% right about that and it won’t get your job back.

Other people already explained the “at-will” concept to you, so I will leave it at that.

Have your workers no rights or no proper labour laws in your country? It’s 2008 not 1808… Go have a talk with a solicitor about unfair treatment and dismissal.

Look under Hotels , Health and Safety Inspectors. Talk with an inspector and ask what are the legalities.
